Q662: Vietnam vet with 80% Agent Orange disability. I am 73 years old and retired. Could I qualify for 100% IU?

A1: Your percentage for your disability is high enough to qualify but you must show a reason that your disability causes you to be unable to gain and hold a study job! The V. A. is not allowed to consider your age as a factor for or against employment. I was 80% and gained 100% total & permanent disability through unemployability. I was 70 years old at the time. I connected my unemployability wit my 70% rating for PTSD. Seek help from a VSO. The online V. A. Website should have some references in your area. (RR) 2/9/21
A2: The answer is, yes, you might qualify. The schedular requirement for IU is that if you have one disability, that disability has to be 60% or more. If you have multiple disabilities, your overall rating has to be 70% w/ at least one of the disabilities being 40%. That 40% could come from combining body systems. ie. DM II @ 20% w/ peripheral neuropathy of both upper and lower extremities when combined w/ the DM II combined to a rating of 40%. Your SC disabilities have to be the reason you are unable to obtain or maintain gainful employment. You will have to complete a VA Form 21-8940 and, if you can, have your previous employer complete a VA Form 21-4192. When you file for IU and tell the VA which disabilities prevent you from working, you will be reevaluated on those disabilities. After your C&P exams, the VA can increase, leave the same, or lower your ratings based on the results of the C&P exams. (DS) 2/9/21

A4: Yes, you could qualify for individual unemployable by filing a 21-526ez on page 9 put in individual unemployable and submit that to the VA and then you get a letter with a form to fill out as well as your employers. (GR) 2/9/21

A6: Contact the VSO who has your POA or an Accredited VSO with the Am Legion, Am Vets, VFW, DAV or another veterans service organization. The VSO can assist you in filing for IU and explain what is necessary to obtain IU. I recommend that you do not try to file this claim yourself. This can be a tricky claim. Advice from stockade lawyers does not help. The claim is between you, the VSO and the VA. (GH) 2/11/21
