Q715: I have non-hodgkins lymphoma which the VA agreed was caused by my exposure to contaminated water at Camp Lejeune from 1969-1971. However, I was not awarded disability compensation because my blood platelets are above 100 by a few points even though I received 2 bouts of chemo over 7 yrs and numerous cat scans, pet scans and x rays. What can I do to get compensation?

A1: Non-Hodgkin's lymphoma is a type of cancer that begins in your lymphatic system, which is part of the body's germ-fighting immune system. In non-Hodgkin's lymphoma, white blood cells called lymphocytes grow abnormally and can form growths (tumors) throughout the body.
With active disease or during a treatment phase ????. 100%
The 100 percent rating shall continue beyond the cessation of any surgical, radiation, antineoplastic chemotherapy or other therapeutic procedures. Six months after discontinuance of such treatment, the appropriate disability rating shall be determined by mandatory VA examination. Any change in evaluation based upon that or any subsequent examination shall be subject to the provisions of 3.105(e) of this chapter. If there has been no local recurrence or metastasis, rate on residuals.
Simply put, while in treatment you should be rated during your treatment. Once the treatment is finished, you no longer have this illness; therefore, you can not be rated for the illness.
You should now file for the residuals which resulted from your treatment.
These should be filed as a secondary condition to the non-Hodgkin's lymphoma. (RJ) 5/19/21
