Q460: If the VA made an error toward your rating of a disability and later they admit it, are they liable for compensating me for their error which was 15 years ago and what type of claim do I submit?

A1: I recommend you contact an Accredited VSO from the VFW, Am Legion, Amvets, DAV or another Service Organization, Take all of your correspondence from the VA. If you have proof of an error your VSO will advise and take the proper steps. (GH) 7/11/20
A2: They should. I have heard of it happening and they went back years to correct the problem. (RG) 7/11/20
A3: Yes they will. I did not know that they made a mistake. The VA found it and paid me back pay for a lot of years. (JP) 7/11/20
A4: I was 100 for 20 years they put me two 10%. (JH) 7/11/20
A5: They paid me for there mistake. They had to go way back and paid me. I put in for a claim and the VA found the mistake. I did not put in for it. (JP) 7/11/20
A6: If the VA discovers the error, they will fix it and compensate you back to the date of the error. If you discover it, file a VA form 21-0995 and file a clear and unmistakable error (CUE). The VA will either recognize their error or tell you why your CUE is wrong. (DS) 7/13/20
