Q428:  My husband has been rated 80 percent but being paid at 100% due to individual unemployability since 2008.  Should we have this changed to 100% or doesn't this matter?  If he should pass would it make a difference how this is worded as to 80% with unemployability or a straight 100%?  Also he has been home and I have been his caretaker for over a year. Bathe him, shave him, feed him, take care of doctors appointments and medicine. Should I be filing a claim? He gets a pension from his work and SS and the VA...I only get SS...appreciate all advise...can't get to the DAV because of the COVID-19 in the area.

A1:  It sounds like your Husband is more or less invalid. You should submit a claim with your VSO for the issues he presently has and any additional issues. A new review could reveal a 100% P&T.  (RS)  5/29/20

    

A2:  I am rated at 70% but receive unemployable 100% benefit. Your husband should be receiving benefit letter from the VA every year to certify that he is not working. Find a copy of that letter and write to VA for clarification. I, too need to ask the VA that very same question.  Another thing you might do is to contact the nearest American Legion, VFW, DAV organization to ask for help.

A3:  You need to contact an accredited VSO from the VFW, DAV, American Legion or other service organization for assistance. You must remember the Virus situation is in every state and affects all the VSOs. Also, you need to read the VA decision letter and award letter. If it states no further C&P exams you do not need to worry. You should also have a VSO file for Aid & Attendance if he is housebound like you state. This would give you money for assistance. Also if he is unable to sign get the VSO to file an alternate signer form. This form will help you in assisting the veteran if other compensation is needed. Also go with him to his next appointment with his primary care doctor at the VA and ask if he has requested HISA to do the home renovations to support the veteran. Also find out which VA Social Worker is assigned to the team your husband is assigned. Then see the Social worker and ask about home care for the veteran.  (GH)  5/29/20
