Q381:  I don’t get it.  I got a letter from my psychiatrist stating that I was too depressed to work, and that my depression was related to my service-connected problems.  I am currently rated at 80% by the VA.  In fact, I haven’t worked in 10 years because of ongoing bouts of depression and service-connected problems.  I applied for VA unemployability and have been denied 3 times.  My psychiatrist clearly spelled out to the VA I will never be able to work again.  Is it time for me to hire a law firm to help with this case?  My VSO has not been any help.

A1:  There is usually one reason for denial of IU and that has to do with the employment records and being able to prove that for the time you came out of service until you were unable to work. I have had to do some exhaustive research with veterans in this area.  (GR)  3/22/20

    

A2:   Get a new VSO try a DAV service officer.  (PJ)  3/22/20

   

A3:  You might consider taking your denial letters and contact another VSO organization or go online and look up local VA certified private attorneys or agents in your area. When was the last time you were denied. If it was within one year you can ask another VSO to file a reconsideration, if more than a year you can ask for an appeal under the VA's new accelerated appeals program. A4:  Appeal, appeal, appeal. Take your claim to the Board of Veterans' Appeals. Regional Offices are very unsympathetic.  The BVA law judges will give you a fair assessment.  (JD)  3/23/20

    

A5:  I understand what you are going through, I have similar problems but they, meaning the V.A. who making those decision don't think beyond the box, I have to prove that there is a Sientific evidenance in order for me to get my cliam approved. The Sientific people who made the Agent Orange are dead, how can I have any prove. People have side effects, are facing a loosing battle. The V.A. are not helping you, instead they can guide you with the right people to help you, but they rather deny and role play that they are there to help you.  (EC)  3/26/20
