Q432:  I am 90% because of diabetes caused by Agent Orange. I also get ED pay as well.  I also have hearing loss pay.  Now they took my CDL so I need back pay as they say I have dementia caused by Agent Orange. How do I go about getting my back pay?  Please help me get the money I need.

A1:  Why do you believe the VA owes you back pay?  You should immediately file for Individual Unemployment. It is very important to get verification from you last employer that you are unemployed because your service-connected diabetes caused the loss of your CDL. You should go through an accredited Service Officer who can assist you with the applicable VA forms.  (AB)  5/31/20

A3:  Are you being paid at the 100% rate due to IU?  You did not specify. You need to read the VA award letter and VA decision letter. If it states no further C&P you are at 100%.  Who said you had dementia and it was caused by Agent Orange? Have the professional put it in writing that more likely as not it was caused by exposure to Agent Orange or it is secondary to an existing condition. However, you need to contact an accredited VSO with the VFW, American Legion, DAV or another service organization to advise you on your situation. There is no back pay for a claim that has never been submitted. If you have a claim on appeal and it is approved you will be paid from date of the denied claim.  (GH)  6/1/20
