Q426:  I got a SOC letter denying 3 claims. A C&P report was done with no input from me. It is obvious the person that did the evaluations did not look at all of my VA records, NODs, DBQs and medical literature, before denying my claims. Can anybody help correct this? No help from State of Delaware, DAV, or American Legion.

A1:  Brother, knowledge is power. Go to your local library and obtain this. Study chapters 2 and 3 and resubmit. https://store.lexisnexis.com/products/veterans-benefits-manual-and-federal-veterans-laws-rules-and-regulations-bundle-skuSKU12950/details Or you can hire a Law firm to assist legally. They usually charge a % if your entitlement, but it'll get you on your way to being compensated for your service connected injuries/issues. I resorted to the latter and came out 70% after being evaluated at 10% for a few years. It takes time, but the new online process makes it much easier. Hope this helps. Hoooah.  (LS)  5/26/20

A2:  Best advise, get a lawyer. It does not cost you anything until your claim is settled which is generally 25% to 30% of your final payment of all the back pay they owe you from when you originally applied any other claims you have filed since then or if the original condition has gotten worse whi h would in rese your disability. But your attorney should know all of this. The attorney is not eligible to collect any monies from you monthly disability Che hs you will start receiving after you have been approved. His money come from the lump sum payment they will give for all the last months or years your were not getting your rightful disability.  (LT)  5/26/20
